Terms of service
These Terms of Service ("Terms") govern the purchase of products and use of services on "GT-Rotaku.com" (the "Site"), operated by LULL Inc. ("we," "us," or "our"). By using the Site, all customers (regardless of membership status) are deemed to have agreed to these Terms.
Article 1 (Definitions and Applicability)
- "User" means any person who browses, uses, or purchases products on the Site.
- "Member" means a User who has completed registration through our prescribed procedures.
- Guides, notices, and help content displayed on the Site from time to time constitute part of these Terms.
- In case of conflict between these Terms and individual explanations or guides, the individual explanation shall prevail.
Article 2 (Member Registration and Account Management)
- Please register using true and accurate information. Proxy registration by third parties is not permitted.
- Members are responsible for managing their email address and password and must not lend or transfer them to third parties.
- We shall not be liable for damages arising from unauthorized use of account information, except in cases of our willful misconduct or gross negligence.
- Please promptly notify us of any changes to your registered information.
Article 3 (Product Information and Compatibility)
- While we strive for accuracy in product images, specifications, and pricing, actual colors may differ due to display environments.
- Final determination of compatibility for automotive parts is the customer's responsibility. Installation may not be possible depending on model year, grade, or modifications.
- We recommend installation by a qualified mechanic. We are not liable for defects or accidents resulting from self-installation.
- Products with manufacturer warranties are subject to each manufacturer's warranty terms. Deterioration from long-term use, normal wear, or customer mishandling may not be covered.
- Products marked "for racing use only" or "not for public road use" must be used in compliance with applicable laws. We bear no responsibility for accidents or violations arising from use on public roads.
- Used or rebuilt products are sold with the customer's acknowledgment of the condition described for each item.
Article 4 (Formation of Contract)
- A sales contract is formed when the customer completes the order process and we send an order confirmation email.
- We may cancel or rescind a contract even after formation in cases such as stockouts, pricing errors, payment denial, or suspected fraudulent orders. Any payment received will be refunded.
Article 5 (Pricing and Payment)
- All prices are tax-inclusive. Shipping fees and other charges are specified in the "Specified Commercial Transactions Act Disclosure."
- Payment is by credit card only (additional methods will be announced on the Site if added).
- Payments are processed under each card company's terms. Orders may not be accepted depending on credit screening results.
Article 6 (Shipping and Delivery)
- Orders are typically shipped within 1–3 business days after payment confirmation (exceptions noted on product pages or by email).
- Orders placed on weekends, holidays, or our company holidays will be processed from the next business day.
- Delivery may be delayed due to natural disasters, traffic conditions, or customs clearance.
Article 7 (International Shipping and Customs)
- Where international shipping is available, availability, methods, and fees vary by region.
- Customs duties, import taxes, and customs fees are generally the customer's responsibility (charged by the carrier or customs authority).
- International returns are generally not accepted due to customs and shipping costs (initial defects will be handled individually).
Article 8 (Returns, Exchanges, and Cancellations)
- For defective, damaged, or incorrectly shipped items, please contact info@gt-rotaku.com within 7 days of arrival with your order number and description of the issue. We will provide a replacement or refund (shipping covered by us).
- Customer-initiated returns (compatibility issues, different from expectations, ordering mistakes, etc.) are accepted within 7 days of arrival for unopened, unused items. Round-trip shipping and payment fees are the customer's responsibility.
- The following items cannot be returned or exchanged: installed or used items, modified or painted items, made-to-order or custom items, outlet or sale items.
- Cancellations are accepted before shipping is arranged, but may not be accepted once shipment preparation has begun.
- Mail-order purchases are not subject to the cooling-off period and are handled according to the special provisions in this article.
Article 9 (Warranty and After-Sales Service)
- Where manufacturer warranties apply, they follow each manufacturer's terms. Proof of installation and photos of defects may be required for warranty claims.
- We shall not bear indirect damages beyond what is permitted by law, including damage to vehicles or other parts, loss of business, or installation/removal labor costs.
Article 10 (Prohibited Activities)
The following activities are prohibited when using the Site:
- Violations of laws or these Terms
- Infringement of rights of us or others, or interference with business
- Cyberattacks including unauthorized access or malicious programs
- Registration of false information
- Sharing accounts or passwords with third parties
- Any other activities we deem inappropriate
Article 11 (Intellectual Property)
All copyrights, trademarks, and other rights in content on the Site (text, images, logos, data, etc.) belong to us or legitimate rights holders. Reproduction, republication, or modification without prior permission is prohibited.
Article 12 (Service Changes and Interruptions)
We may change, suspend, or terminate the Site without prior notice due to system maintenance, force majeure, or other unavoidable circumstances.
Article 13 (Disclaimer)
- We shall not be liable for delays, interruptions, data loss, or virus damage due to communication failures, system failures, or natural disasters, except in cases of our willful misconduct or gross negligence.
- Final compatibility determination, installation, and legal compliance are the customer's responsibility. We are not liable for damages arising therefrom.
- Even where our liability is recognized, compensation is limited to the purchase price of the relevant product (except in cases of our willful misconduct or gross negligence). This does not apply where the Consumer Contract Act or other laws prohibit limitation of liability.
Article 14 (Language, Governing Law, and Jurisdiction)
- These Terms are governed by the laws of Japan.
- Any English or other translation of these Terms is provided for reference only. In case of discrepancy, the Japanese version shall prevail.
- Any disputes relating to these Terms or transactions shall be subject to the exclusive jurisdiction of the Tokyo District Court.
Article 15 (Amendments)
We may amend these Terms as necessary. Amended Terms take effect upon posting on the Site.
